Terms of Use

These Terms of Use (“Terms”) govern your use of the PactKeeper mobile applications for Android and iOS (“the app”). By downloading or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. Who we are

PactKeeper is operated by Martin W Smith Consulting Limited, a company registered in England and Wales (“we”, “us”, “our”). Contact: support@mws-consulting.net.

2. The service

PactKeeper is a daily accountability app. You choose one commitment per day, check in each evening, and track your streak and history. The app may provide a short AI-generated witness line after check-in. Features may change as we improve the app.

3. Accounts and eligibility

You may start using the app without creating an email/password account. We create an anonymous session so your data can sync securely. You may optionally link an email with a passwordless sign-in link to back up and restore your streak on a new device. Without linking an email, deleting the app or changing phones may permanently lose access to that anonymous account. You must be at least 13 years old (or the minimum age required in your country) to use the app. You are responsible for activity on your device and for keeping your device secure.

4. Subscriptions and billing

PactKeeper offers a limited free trial period in the app, followed by an optional paid subscription processed by Apple (App Store) or Google (Play Store). Current offering:

Payment is charged to your Apple ID or Google account. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel in your device’s subscription settings (App Store or Play Store). We do not process card payments directly.

Refunds are handled by Apple or Google under their policies. We cannot issue refunds for purchases made through those stores.

5. Acceptable use

Use the app lawfully and constructively. Do not attempt to disrupt the service, reverse engineer it, or use it to harass others. Commitment text that promotes illegal harm or abuse may be blocked by automated safety checks.

6. Disclaimer

PactKeeper is provided for personal accountability and is not medical, mental health, or professional advice. AI responses are brief witness lines only — not coaching or therapy. The app is provided “as is” to the extent permitted by law.

7. Limitation of liability

To the fullest extent permitted by applicable law, Martin W Smith Consulting Limited is not liable for indirect, incidental, or consequential losses arising from your use of the app. Nothing in these Terms limits liability that cannot be limited under UK law (including for death or personal injury caused by negligence, or fraud).

8. Privacy

Our Privacy Policy explains how we collect and use personal data. By using the app, you also agree to that policy.

9. Changes

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use after an update means you accept the revised Terms.

10. Governing law

These Terms are governed by the laws of England and Wales. Courts in England and Wales have exclusive jurisdiction, except where mandatory consumer protection laws in your country give you the right to bring claims elsewhere.
